Terms and Conditions (AGB)

Language: Deutsch · English

Effective date: 20.09.2026

PART A - General provisions and platform use

§ 1 Scope and contracting parties

The following Terms and Conditions (hereinafter Terms) apply to the use of the online platform plentyvents (hereinafter Platform), operated by

Lukas Schulte-Tickmann
Wittelsbacherstr. 29
85586 Poing
Germany

(hereinafter Operator). Contact details are set out in the Imprint.

The Platform provides the technical framework for organizations (hereinafter Organizers) to offer admission tickets for their own events and for end customers (hereinafter Buyers) to purchase them. The Platform includes in particular the admin interface, the checkout, and the API.

Intermediary role only: The Operator acts solely as an intermediary for contracts between the respective Organizer and Buyers. Contracts concerning the purchase of tickets, attendance at the event, and its performance are concluded exclusively and directly between Organizer and Buyer. The Operator does not become a party to these event contracts.

§ 2 Scope of the Platform’s services

The Operator provides the technical framework so that Organizers can create events, manage ticket types and quotas, offer digital tickets, use optional features (including check-in, waitlist, member area, vouchers), and connect the Organizer’s payment interfaces.

The Operator strives for high availability of the Platform but does not guarantee uninterrupted technical accessibility. Maintenance, security updates, or disruptions outside the Operator’s control may cause temporary limitations. Features may change. There is no entitlement to individual features.

PART B - Terms for Organizers (B2B)

§ 3 Registration, duties, and warranties of the Organizer

Use of the admin interface requires user accounts created by the Operator or the Organizer. The Organizer must provide complete and truthful information, in particular imprint details, contact data, and the payment methods used for ticket sales (for example PayPal credentials, IBAN, WERO details).

The Organizer warrants that it holds all required rights and, where necessary, official permits to carry out the listed events and to publish the related content (images, descriptions, logos, trademarks) on the Platform.

The Organizer indemnifies the Operator against third-party claims arising in connection with its offers, content, or the performance of its events (including copyright and trademark claims and defects of the event), unless the Operator itself is responsible for the underlying breach.

Accounts and access credentials must be handled carefully. The Operator may suspend or delete accounts in case of misuse, security risk, or breach of these Terms.

§ 4 Fees, payment processing, and invoicing

For use of the Platform, the Operator charges the Organizer fees according to the rates agreed or set in the admin interface (in particular a monthly base fee and prices per event and per ticket sold). Billing is to the Organizer, usually by SEPA direct debit under a stored mandate.

Direct payment / no custody of customer funds: Payment for ticket purchases is processed directly between Buyer and the respective Organizer via the methods set up by the Organizer (the Organizer’s PayPal, bank transfer, WERO, box office) or via the Organizer’s vouchers. The Operator never receives customer funds for ticket purchases, does not operate escrow accounts for ticket revenue, and does not hold deposits for the Organizer.

§ 5 Cancellation, rescheduling, refunds, and settlement

Decisions on cancellations, rescheduling, refunds, or reimbursements relating to events rest exclusively with the respective Organizer.

The Operator is neither obliged nor entitled to refund the ticket price on behalf of the Organizer. Buyers’ claims for reimbursement in case of cancellation or defects of an event must be asserted directly against the Organizer.

The Organizer must promptly inform affected Buyers in case of rescheduling or cancellation.

PART C - Terms for Buyers

§ 6 Conclusion of contract and allocation of roles

By listing and enabling an event on the Platform, the respective Organizer makes an offer to sell admission tickets.

The Buyer accepts this offer by completing the checkout process and, where a payable amount remains, selecting a payment method offered by the Organizer. The contract concerning event attendance is concluded exclusively between the Buyer and the Organizer named in checkout.

The Operator assumes no warranty and no liability for the performance, quality, safety, or legality of the event.

§ 7 Statutory exclusion of the right of withdrawal

Notice under § 312g (2) no. 9 of the German Civil Code (BGB): Pursuant to § 312g (2) no. 9 BGB, consumers have no right of withdrawal for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for performance, unless otherwise expressly agreed. The purchase of date-bound event tickets is therefore generally binding with immediate effect.

§ 8 Delivery of digital tickets

Tickets are provided exclusively by electronic means (for example as a PDF attachment by email, as a download in the member area, or as a QR code at the entrance). There is no postal delivery of paper tickets.

The Buyer must present the digital ticket in a readable form (printed or on a smartphone) at the entrance, as required by the Organizer.

Depending on the Organizer’s payment method, the ticket may initially remain unpaid (for example bank transfer, WERO, box office) until the Organizer confirms receipt of payment or the entrance process so provides.

PART D - Liability, data protection, and final provisions

§ 9 Liability of the Operator

The Operator is liable without limitation for damage arising from injury to life, body, or health caused by an intentional or negligent breach of duty by the Operator, as well as for other damage in cases of intent and gross negligence and under the Product Liability Act.

In case of slightly negligent breach of material contractual duties, the Operator’s liability is limited to the foreseeable damage typical for the contract.

The Operator assumes no liability for cancellations, postponements, quality, defects, or damage in connection with the performance of the mediated events, or for disruptions at the Organizer’s payment service providers. The contracting party for these matters is exclusively the respective Organizer.

§ 10 Data protection

The Operator processes personal data in accordance with the GDPR and, where applicable, the TDDDG. To conclude and perform the ticket purchase, the Platform transmits the Buyer data necessary for the contract to the respective Organizer. Further information is set out in the Privacy Policy.

§ 11 Governing law and venue

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the state in which a consumer has their habitual residence remain unaffected.

If the contracting party is a merchant, a legal entity under public law, or a special fund under public law, the exclusive venue for disputes arising from use of the Platform is the Operator’s place of business.

The Operator is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.

The Operator may adjust these Terms if the offering or the legal situation changes. The version published on this page is authoritative.
